Sponsorship. The Sweepstakes sponsor is Tournaments for Charity d/b/a Ascension Charity Classic (“Sponsor”), located at 1 Norwood Hills Country Club Dr, St. Louis, MO 63121. Sponsor will conduct the Sweepstakes substantially as described in these Official Rules.
Eligibility. The Sweepstakes is open to all individuals who are legal residents of the 50 United States and District of Columbia and who are at least 18 years old at time of entry (each a “Participant”). Sponsor does not warrant that this Sweepstakes is valid in any particular jurisdiction. Members of the working media that were credentialed for the 2022 Ascension Charity Classic presented by Emerson are not eligible. Sponsor and its affiliates, agents, representatives, officers, directors and employees, and any entity involved in the development, production, implementation, administration, judging or fulfillment of the Sweepstakes, including without limitation the immediate family members of any such individuals, are not eligible to participate. Any potential winner will be subject to verification by Sponsor, whose decision is final and binding in all matters related to the Sweepstakes. A Participant is not a winner of any Prize, even if the Sweepstakes so indicates, unless and until the Participant’s eligibility has been verified. Sponsor will not accept evidence of winning in lieu of its validation process.
Where Void. The Sweepstakes is void outside the USA, including in Puerto Rico, the US Virgin Islands and other United States territories and possessions. Participants in jurisdictions where the Sweepstakes is prohibited are ineligible to participate in the Sweepstakes.
Agreement to Official Rules. Participation in the Sweepstakes constitutes a Participant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Entry Period. The Sweepstakes entry period begins on Monday, March 20, 2023 at 12:01am CDT and ends on Sunday, April 9, 2023 at 11:59pm CDT (the “Entry Period”). Eligibility for entry into the Sweepstakes will cease at the applicable time and date, and all entries that are submitted before or after the Entry Period will be disqualified. Sponsor’s computer used for the Sweepstakes will be the official timekeeping device for the Sweepstakes. Sponsor reserves the right to end the Sweepstakes at any time, including prior to the expiration of the Entry Period.
How to Enter. Participants will automatically be entered into the Sweepstakes by purchasing during the Entry Period one or more tickets to the 2023 Ascension Charity Classic presented by Emerson being held on September 5 – 10, 2023 at Norwood Hills Country Club in St. Louis, Missouri, provided that at the time of the purchase of tickets the ticket purchaser has provided the requested limited contact information consisting of his/her name, email address and phone number. Also, Participants may during the Entry Period enter the Sweepstakes by visiting Sponsor’s website at www.ascensioncharityclassic.com (“Sponsor’s Website”) and following the instructions to electronically complete (by providing limited contact information consisting of your name, email address and phone number) and submit the entry form; all required fields of the entry form must be completed with information that is valid on the date of entry to be eligible. All entries become the property of Sponsor and none will be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, invalid, illegible, or misdirected entries, which will be disqualified, or for any error, whether human, technical, or otherwise. Sponsor shall not be liable for any damages whatsoever related to or arising from any technical errors that may prevent any Participant from participating in any way, unauthorized human intervention in the Sweepstakes, and/or errors in the administration of the Sweepstakes.
Limitations on Entries. THERE IS A LIMIT OF ONE ENTRY PER PERSON AND PER EMAIL ADDRESS. No third-party entry or entry through any sweepstakes service is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities, uses any device or artifice to enter or encourage multiple or false entries, otherwise tampers or attempts to tamper with the operation of the Sweepstakes, or has been deemed to be acting in violation of these Official Rules, as determined by Sponsor in its sole discretion, will be disqualified. The use of robotic or automated entry devices is strictly prohibited.
Sweepstakes Grand Prize. One (1) winner will be awarded one (1) Sweepstakes grand prize (the “Prize”) consisting of two (2) weekly (Friday – Sunday) clubhouse passes for the 2023 Ascension Charity Classic presented by Emerson, one (1) foursome of golf at Norwood Hills Country Club (West Course) on a mutually agreeable date in the fall of 2023 and certain Classic merchandise (subject to availability). Travel, meals, lodging, tipping, transportation, and additional expenses are not included and shall be the sole responsibility of the winner. The Prize is valued at $1,250, and Sponsor reserves the right to substitute components of the Prize of equal or greater value. The Prize is awarded AS-IS and without any warranty of any kind. No transfer, cash equivalent, or substitution is permitted, except at Sponsor’s sole discretion. The winner may be required to provide his/her Social Security number for tax reporting purposes, and the winner may also be issued an IRS 1099 form for the value of the Prize. The winner may waive his/her right to receive the Prize.
Drawing. The winner will be selected in a random drawing from among all eligible entries collected during the Entry Period on or about Wednesday, April 12, 2023. The drawing will be conducted by Sponsor or its representative, whose decisions and interpretations on all matters relating to the Sweepstakes and these Official Rules are final and binding in all respects. Sponsor reserves the right to disqualify any Participant or winner and may refuse to award the Prize to a person who is not eligible or has violated a rule, gained unfair advantage in the Sweepstakes or obtained winner status using fraudulent means. If there is a dispute about the identity of the winning entrant, the Prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the submitted email address. If the potential winner cannot be reached within seventy-two (72) hours of the Prize drawing, if any Prize notification is returned as undeliverable, if any potential winner rejects his/her Prize, or in the event of noncompliance with these Official Rules, the potential winner may be disqualified, his/her interests in the Prize may be forfeited, and Sponsor may choose, in its sole discretion, whether to select a substitute winner from among all the remaining eligible entries by random drawing. Upon Prize forfeiture, no compensation will be given. The substitute winner (if applicable) is subject to all requirements set forth in these Official Rules.
Odds. The odds of winning the Sweepstakes will depend on the number of eligible entries received by Sponsor.
WARNING. ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
General Terms. By entering the Sweepstakes, all Participants agree to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. Sponsor will not be responsible for any injury, damage or loss of any kind arising out of any participation in the Sweepstakes. ALL PARTICIPANTS AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS SPONSOR AND ITS AFFILIATES, AGENTS, REPRESENTATIVES, OFFICERS, DIRECTORS AND EMPLOYEES FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, INJURIES AND DAMAGES RESULTING FROM PARTICIPATION IN THE SWEEPSTAKES.
Except where prohibited by law, by accepting the Prize, the winner grants Sponsor a perpetual, worldwide, royalty-free license to use the winner’s name, photograph, voice and/or likeness without further authorization, compensation or remuneration of any kind for advertising, promotion and other publicity purposes in any and all media now or hereafter known throughout the world.
Limitation of Liability and Release. By entering the Sweepstakes, accepting and using the Prize, and/or attending the Classic, the winner hereby agrees to defend, indemnify, and otherwise hold harmless Sponsor and its respective parents, subsidiaries, affiliated companies, agents, officers, directors, and/or employees (collectively, the “Released Parties”) against and from any and all liability of any nature whatsoever arising out of or relating to (a) unauthorized human intervention in the Sweepstakes by or directed by the winner; (b) breaches of or inaccuracies in any representations or warranties made by the winner, or of any other terms and conditions contained herein; and/or (c) injury, death, and/or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the winner’s participation in the Sweepstakes or receipt, use, or misuse of the Prize, including any such claim made by the Released Parties’ employees or agents or any other third parties.
By entering the Sweepstakes, accepting and using the Prize, and attending the Classic, the winner (1) agrees to release Sponsor and the Released Parties from any and all liability from any loss, harm, damages, costs, and/or expenses, including without limitation property damages, personal injury, and/or death, arising out of participating in the Sweepstakes or the acceptance, possession, use, or misuse of the Prize, (2) waives any and all claims against Sponsor and/or the Released Parties based on publicity rights, defamation, invasion of privacy, or any other intellectual property or privacy right, and (3) acknowledges that Sponsor neither has made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including without limitation fraud, virus, or other technical problem, Sponsor may, in its sole discretion and at any time, (x) suspend the Sweepstakes to address the impairment and then, at Sponsor’s sole discretion, resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules, (y) award the Prize from among the eligible entries received up to the time of the impairment, and/or (z) terminate the Sweepstakes.
Disputes. Except where prohibited by law, each Participant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, the Sweepstakes or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Missouri. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Participants’ rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Missouri without giving effect to any choice of law or conflict of law rules (whether of Missouri or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than Missouri.
Winner’s Name. The name of the winner will be available within ten (10) days after the close of the Sweepstakes at the end of the Entry Period. The name of the winner will be posted on Sponsor’s Website.
Limited Use of Contact Information. The winner’s email address and/or cell phone number will be used by Sponsor to communicate with with him/her regarding the Prize described herein. While participation in the Sweepstakes is limited to persons eighteen (18) years of age and older (the “Participation Age Requirement”), the following is nonetheless stated regarding persons under the age of thirteen (13) years while not altering the Participation Age Requirement: Participation in the Sweepstakes is not conditioned upon the provision of any personal information to Sponsor by any person under the age of thirteen (13) years. If you are under the age of thirteen (13) years, do not provide Sponsor with any personal information about yourself, including your first or last name, address, phone number, email address, picture, or similar information. Sponsor does not seek to collect, and will not knowingly accept, personal information from persons under the age of thirteen (13) years.
Email Authorization. By entering the Sweepstakes, Participants agree to receive email communications from Sponsor.
